Employment Defamation and Slander Cases

Male: This is the Talk of the Town Extra.

Tuwanda Coleman: I’m Tuwanda Coleman. Do you believe your employer has defamed you in some way by making false statements about you? Atty. Jim Higgins is here to talk about what does or does not constitute employment defamation. Welcome, Jim.

Jim Higgins: Thank you.

Tuwanda Coleman: You got a lot of calls about this in your office.

Jim Higgins: Yes.

Tuwanda Coleman: How would you define employment defamation?

Jim Higgins: It’s tough, you know, they’re tough cases and, you know, hurt feelings saying, “Hey, you’re a rotten employee.” You’re telling someone else that this person was a rotten employee probably not defamation.

Tuwanda Coleman: Yes.

Jim Higgins: That - you know, those opinions really (witting)[00:00:39] them out to a lawsuit. It’s enough to hurt your feelings. It’s enough to make angry, but probably not litigation. The cases that we’ve taken from an employment standpoint in our employment division where there’s defamation is where an employer has reported a fact to a third party that’s truly false.

Like for instance if they tell a new perspective employer that, “Hey, this person stole,” or, “This person did something illegal at our office and that keeps our client from getting a job.” Then, it becomes a potentially actionable claim.

Tuwanda Coleman: Yes. So, what should someone do though if they feel like just as you have just said...

Jim Higgins: Yes.

Tuwanda Coleman: ...this has happened to me, what do I do next?

Jim Higgins: Well, you know, the biggest thing is you got to get - try to get proof of it.

Tuwanda Coleman: OK.

Jim Higgins: You know, people love social media today, you know, good and bad. So, if they have an employer or coworker that puts on the website some of the false, print it. Take a picture of it. An email, a text, whatever you can and they’re welcome to call our office and talk about it and we’ll tell them if we think it’s something that’s - that it’s worthwhile pursuing a claim or maybe not, sometimes there’s different avenues.
