Instead of incorporating in Delaware, will more businesses be incorporating in Texas?

Elon Musk was upset about the Delaware Court of Chancery denying him his compensation package. It may have affected tesla stock, but this is not a tesla stock prediction. Aside from tsla stock price, the board of directors must abide by fiduciary duties.

Elon Musk has already moved the great SpaceX to Texas. Tesla’s headquarters have already moved from the Palo Alto networks to the slopes of Mount Bonnell in Austin. Even the Boring Company has moved to Bastrop county, on the banks of the Colorado River Bastrop.

But more companies not owned by Musk may follow. Texas is set to open the Texas Business Courts, which handle commercial disputes and complex litigation matters. The Texas legislature has also bolstered their LLC laws, by allowing for the LLC charging order for both single member LLCs and multi member LLCs. Now both types of LLCs have a charging order of protection.

Will Texas overtake Delaware? Only time will tell.
