A former DUI prosecutor discusses the consequences when someone with a Class A commercial drivers license gets arrested for DUI (drunk driving or driving under the influence) in California. This section is found in California Vehicle Code 23152(d) VC.
In court, the standard for a commercial driver driving a commercial vehicle is a blood alcohol concentration (BAC) of .04. If the person is found guilty of DUI, he will endure a suspension / revocation of his Class A commercial drivers license for one year. On a second offense DUI, the Department of Motor Vehicle (DMV) will impose a lifetime suspension / revocation.
A good criminal / DUI defense lawyer may be able to get the charges reduced or dismissed in court and to win the DMV hearing to save your commercial drivers license.
We represent truck drivers, bus drivers, government employees and others whose jobs require a commercial license.
