In Mullin v Sherlock 2018 ONCA 1063, the Ontario Court of Appeal examines what is the appropriate order to make when a party repeatedly fails to provide disclosure and answers to undertakings. The Court of Appeal provides a test for whether pleadings should be struck, and what remedies are appropriate.
