Joanna: [00:05:06] All right. So my boyfriend was convicted of assault with a deadly weapon and there was a gun charge added and he was sentenced to 18 years. Do you think your law firm can help him out to determine what new laws are in effect that could possibly shorten his sentence?

Stephen D. Klarich: [00:05:23] Yes, absolutely. Laws have changed since he was convicted. An example of your boyfriend's case or your husband's case. It's AB 1509 enhancements used to be mandatory. They tack on additional time for owning a gun, possessing a gun at the crime at the time of the crime. Now, however, it's discretionary the judge doesn't have to give him all that time. No, I'm not saying the judge will, but he has a right to be resentenced if you look at 1170.23 as amended. You can file a writ of habeas corpus and ask to be resentenced based upon the new law, not the law. He was sentenced on, but the new law, and our firm is getting many cases exactly like those facts, actually.
